7 basic principles of constitution
(Gabi, Brent, Damon, Ben)
Popular sovereignty
Popular sovereignty is when the people have the power of the government. They believe citizens control voting and rules. This means the government does not have all the power. It can be located in the preamble of the constitution.
To make people's unalienable rights safer, the power goes to mostly to the people who choose them for election, that is, it gets its power from the people who had elected them, and the government's power does not come from God, not of any other religious beliefs. If a government does not use its powers for the good of the people, the people have the right to change or remove that government.
Republicanism
Republicanism is with people that can elect people to run the citizens government. they can abolish the government, if wanted. They will elect many representatives to take over different positions. It can be located in article I section two, article III section three and four, article IV section two, and article V section two and four.
Republicans wanted to keep most power at the state or local level.
Federalism
Federalism is all states are free and independent. Texas is only that they are subject to the to the U.S. constitution. However, states have to be self governed. It can be located in article I section one, article XVI section twelve
Separation of Powers
The Texas constitution separates the government into three branches. They did this to get different types of government. They are helping keep it safe. It can be located in article II section one.
Example: The current health care debate. Congress passed legislation that some think is over stepping their powers so the Supreme Court will soon be deciding on whether or not that is constitutional.
Checks and balances
Checks and balances are used to keep the government with same power. It also allows others to impeach someone else. It ensures no branch gains too much power. It can be located in article XV, article IV, article III section 33, article VIII section 6, article III section 40.
Checks and balances makes sure no one goes power hungry.
Limited government
The governor has limited power thanks to the U.S. constitution. All three branches are limited by the Texas constitution. For example, the legislature has a budget on passing laws. it can be located in article I section 10 of U.S. constitution, article III section 40.
Individual rights
Everybody has certain rights. These rights cannot be taken away. These are freedoms and civic duties. for example, a civic duty is to vote. it can be located in article I section 10 of the u.s. constitution, article I of the Texas constitution, section 3 of the Texas bill of rights.
Everyone has limits from the law, but some in favor dew to how much they supported the campaigner.
